Utobo Anti-spam policy

This policy outlines the principles by which all Users of the Utobo System are expected to abide to ensure compliance with anti-spam laws and to promote respectful and legal use of our Email Marketing Services.

Definition

"Spam" refers to unsolicited e-mail with commercial content sent to a recipient without their prior consent. Spam can take two main forms:

UCE (Unsolicited Commercial Email): Promotional emails sent without the explicit request or consent of the recipient.

UBE (Unsolicited Bulk Email): Mass emails sent indiscriminately without the explicit request or consent of the recipients.

Any capitalized term not defined in this policy shall have the meaning given to it in the Terms of Use, unless the context clearly indicates otherwise.

Policies

Strict Prohibition of Spam: All Users of the Utobo System agree not to engage in the sending of spam using Utobo's Email Marketing Services.

Consent Required: Users agree to send emails only to recipients who have actively consented to receive such messages, specifically acknowledging their consent by providing their email address.

Information Requirements: Each email sent through the System must include:
 

− The sender's name and address in the 'From' header

− A valid 'Reply-to' address

− A footer that contains the sender's contact information

− A highly visible and active 'Unsubscribe' link to enable recipients to opt out from future emails.

− Content Limitations: The content of each email must comply with all applicable laws and generally accepted moral standards. It should not contain any deceptive, misleading, harmful, or offensive information.

 

Unsubscribe Mechanism: Each message sent from the System must include a clear, visible, and functional link or other mechanism that allows recipients to easily unsubscribe from receiving future emails.

Respect of Unsubscribe Requests: If a recipient opts out of receiving emails, Users may not override this choice without obtaining fresh consent from the recipient. Once an individual has opted out, they must not be sent further messages unless they specifically opt back in.

Legal Compliance: All Users of the Utobo System agree to comply with all applicable laws, including but not limited to, those in the USA pertaining to personal data protection and the provision of electronic services.

 

Violations

Utobo takes violations of this Anti-Spam Policy very seriously. Users found to be in violation of this policy may be subject to penalties, including but not limited to, temporary or permanent bans from using our services, legal action, and/or cooperation with law enforcement authorities in their investigation.

Updates to this Policy

We may update this Anti-Spam Policy from time to time, in accordance with changes in laws, regulations, our practices, or for other reasons. We encourage Users to review this policy periodically to stay informed about our anti-spam practices.
