Acceptable Use Policy

Introduction

At Utobo, we are committed to providing a secure and positive experience for all users. This Acceptable Use Policy (AUP) outlines the guidelines for using the Utobo platform. By using the platform, you agree to comply with this Acceptable Use Policy.

Compliance with Laws

You must adhere to all applicable laws while using the Utobo Platform. The combination of our platform with any other tools or resources to engage in prohibited activities is not allowed. It's recommended that you consult an independent legal advisor to understand the laws relevant to your business and usage of the Utobo Platform.

Account Holder Duties

Your actions, content, and interactions with others while utilizing the Utobo Platform fall under your responsibility. You're required to abide by the following rules while using our Platform. If we identify any behaviour or content that doesn't align with this Acceptable Use Policy (AUP), we reserve the right to take appropriate action, which may include restricting access, removing content, reporting it, and/or suspending or terminating your account. We may also adopt preventative measures against uses of our Platform that contradict the intention of this AUP.

Prohibited Actions:

− Engaging in illegal activities or actions where the use or malfunction of the platform could result in physical harm, death, psychological distress, or personal injury.

− Providing access to the Utobo Platform or your content to any individual under the age of 16 (or a higher age if required by local regulations).

− Purchasing, using, or accessing the Utobo Platform with the intent to develop a competing product or service, or for other competitive purposes.

− Disrupting normal operations or attempting to access the Utobo Platform through methods other than the provided interfaces and instructions.

− Bypassing or attempting to bypass any limitations that Utobo places on your account, such as opening a new account after the closure of an original account for policy violations.

− Testing the vulnerability or security of the Platform or any Utobo system or network without written authorization from Utobo.

− Employing any manual or automated system or software to extract or scrape data from websites or interfaces through which our Platform is available without Utobo's written authorization.

− Denying others access to, or reverse engineering, the Utobo Platform, or assisting others in doing so, unless such restriction is legally permissible.

− Transmitting or storing any malicious software, or links to such software, through the Platform.

− Infringing the intellectual property rights of others through the use of the Utobo Platform.

− Reselling or leasing the Utobo Platform without written authorization from Utobo.

− Using the Utobo Platform in a way that imposes industry-specific regulations on Utobo without Utobo's prior written agreement.

− Posting or uploading content that contains personally identifiable, sensitive, or confidential information without the necessary permissions.

− Collecting, storing, or processing health information protected under the Health Insurance Portability and Accountability Act (HIPAA) or other applicable regulations governing health information.

− Creating an account with a disposable or temporary email address, "bots", or other unauthorized automated methods.

− Excessively or abusively using the Utobo Platform in a way that adversely affects its functionality for other users. In such cases, Utobo will attempt to notify you to reduce usage to acceptable levels.

− Recording or monitoring calls, coaching sessions, online meetings, or other communications via the Utobo Platform without complying with all applicable laws and obtaining the necessary consents.

− Violating any acceptable use policies of third-party services that you employ alongside the Utobo Platform, such as Stripe and PayPal.

− Disseminating content that contains false, inaccurate, or intentionally misleading information likely to harm the public interest.

− Furthermore, you're allowed to use any third-party content we provide, such as images or videos, solely within your content. Utobo may modify or withdraw this permission at any time at our discretion. You are not allowed to imply that your content or use of the Utobo Platform is associated with or endorsed by any entity depicted in such materials unless you have their prior written consent.

Consent and Permission

1. Obtain consent and permission: You must obtain consent and necessary permissions when featuring individuals in your content, including media content such as videos, audio, and images.

2. Avoid hidden recordings: Do not capture or use content recorded without the knowledge and consent of the subjects involved.

Content for Children

1. Children under 13: Utobo is not intended for children under 13 years of age. Do not offer courses targeted at or intended for children under 13 on the platform.

Privacy and Impersonation

1. Data protection and privacy: You are responsible for complying with applicable data protection laws and regulations for any data you submit or collect through the Utobo platform.

2. Privacy practices: Disclose your privacy practices when using the platform and act in accordance with those practices.

3. Impersonation: Do not impersonate others when using the platform or collecting information.

Cybersquatting

Cybersquatting, including purchasing an Utobo account in someone else's name with the intent to sell it to them, is prohibited. Cybersquatting accounts are subject to immediate termination.

Email and Text Message Requirements

Utobo has a zero-tolerance spam policy. You must comply with the Anti-Spam Policy when using email and text messages on the platform.

Violence and Hateful Content

Utobo may limit access to or remove content that poses a genuine risk of harm or threatens public safety and health. The platform may not be used to threaten, attack, or organize violence, harassment, terrorism, or property damage. Hateful or discriminatory content is not allowed, including content that promotes violence or supports hate groups.

Bullying, Harassment, and Criminal Activity

Utobo prohibits the use of the platform for bullying, harassment, criminal activity, or any violation of applicable laws.

Terrorist Organizations

Utobo prohibits the offering of goods/services, posting/uploading content, or implying support, funding, or membership in a terrorist organization.

Child Exploitation

Utobo prohibits the offering of goods/services, posting/uploading content, or engaging in activities that exploit or abuse children, including child sexual abuse or exploitation.

Pornography and Offensive Material

Utobo does not allow sexually explicit material intended to primarily sexually arouse users. Offensive or graphic violent material should be avoided unless relevant and properly warned.

Intellectual Property Infringement

Respect the intellectual property rights of others. Ensure you have the appropriate rights for any content or data you use on the platform. Infringing on copyrights, trademarks, or other intellectual property rights is prohibited.

Best Practices

Utobo encourages users to follow best practices when using the platform. Users are responsible for maintaining a positive and safe environment. Seek independent legal counsel if needed.

Utobo's Rights

Utobo does not endorse the content provided by users and is not responsible for it. Utobo may review, modify, and take necessary actions regarding content. Utobo is not obligated to monitor the platform for inappropriate or unlawful content.

Modifications to the Acceptable Use Policy

Utobo may modify this Acceptable Use Policy at any time. Continued use of the platform after modifications constitutes agreement to the latest version.

Reporting Violations

If you come across content that violates this Acceptable Use Policy, please report it to Utobo by contacting support@utobo.com and provide the relevant details and URL where the prohibited content is found.

Consequences of Policy Violations

Utobo reserves the right to take appropriate action for policy violations, which may include suspension, termination of accounts, removal of content, and other measures deemed necessary. Utobo may modify this Acceptable Use Policy at any time, and continued use of the platform implies agreement to the latest version.

Legal Compliance

Failure to comply with applicable laws and regulations while using the Utobo platform may result in account suspension or termination. Utobo reserves the right to report illegal activities to law enforcement authorities.
